'Manager changed my clock-out times': New employees get left alone to close the store, forcing them to clock out an hour late every day, only to find out they don't get paid past closing time

My manager was changing my clock out times for an entire week

Sorry I have one more question is it true that we don't get paid after 8:15? I've been here until like 8:50 the last 4 or 5 days Thursday 6:30 PM So I got u guys at the fastest I can the last few days at 830 but its gotta be close to 815 by next week. If its taking you guys a little longer to close start doing everything a little bit earlier. It just takes time and rhythm. My last closers were out the door by 810 on most days. You'll get there

I was talking to a coworker of mine, I started complaining about the fact that they have two new employees closing alone together, we had both been there less than 2 weeks and there's supposed to be a shift lead closing with us but we simply don't get one bc none of them "want to".

it was taking us until almost 9 pm to close and the restaurant closes at 8.

She proceeds to look at me crazy and go, "you know you don't get paid past 8:15 right?”.
  • 06
No. No I did not know that. So I text my manager and ask and he just casually admits to being aware we were staying that late, changing our clock out times to 8:30, and just not bothering to be like hey, you guys should stop staying so late you won't get paid for it.

That's over an hour of work I will not be getting paid for. The other girl I was closing with was 17 and her mom found out and came in screaming at the manager.

She quit that same day. And on a side note abt none of the shift leads wanting to close, he's got like 9 or 10 ppl opening and 2 closers like they don't need that many ppl to open and for some reason they think we just don't ever get busy as closers but we go through hour long rushes with just 2 of us almost every single day.

OP Beanzz_ZZ Right? This week i haven't been staying past 8:15 we only stayed that long bc no one ever told us. Now morning shift is up my bot though bc they have to do 2 or 3 things when they come in laziest n s I've ever met

Apprehensive Cup7986 The morning shift vs night shift rivalry is manufactured by your boss to keep the blame off of him for his unfair labor practices. Seen it many times.
  • 15
OP Beanzz_ZZ That can be true but my manager had literally gotten onto them before bc one girl was complaining we didn't stock the flavor swirls. That was the ONLY thing we didn't do and he was like "they literally take 2 min to restock" my manager mainly wants the cleaning done which is what takes the longest and is hardest to do with steady customers coming in. Morning shift just abt little things they simply don't want to have to do themselves and it's so annoying. My manager comes in at 3am

Alert-Growth-8326 he is fair to ask you to work faster/start closing duties earlier.... but if you were working till 850, it is 100% illegal for him to change that. ask him to change it back and if he doesn't, talk to a labor lawyer. also, be prepared to start looking for another job. there's a decent chance this will turn into a fight and you don't want to work for someone that you are fighting with.

OP Beanzz_ZZ The other girl I was closing with quit as well so now they're forcing another new employee to close even though her availability wasn't even for close instead of making older more experienced employees close bc they "don't want to".

Dancing Mooses It will cost more to meet with an attorney than OP will ever recover.
  • 19
OP Beanzz_ZZ That's what I'm thinking honestly, this was more of a rant post than anything, legal fees would take up most of what I'd make from that legal battle plus I'd lose my job and it took like 3 months just to find this one. The job search in my area is way to scarce to just go threatening to sue my employers

Eleanor Richmond > her mom came in screaming at the manager Was the middle-aged woman incoherently screaming, or did she loudly inform the manager of the same legal issues people are explaining in this thread? jw
  • 22
OP Beanzz_ZZ I wasn't there when it happened I had the day off, from what I was told she was loudly informing the manager of the legal issues of stealing money from her 17 year old daughter
  • 23
mnl_cntn All of that is illegal in the states. Idk if you're here but if you are you should reach out to a labor lawyer
  • 24
Straightwad That's 100% illegal, need to report this to the state labor board.
  • 25
dirty_corks How nice of him to admit to it in writing. Get with your state's Department of Labor (likely the Wage and Hour division).
